Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mach41 website at mach41.com and Magister, the agentic execution platform provided by Mach41 Ltd ("Mach41", "we", "us"). By using our website or Magister, you agree to these Terms.
If you enter into a separate written agreement with Mach41 (such as an order form, master services agreement, or enterprise licence), that agreement prevails where it conflicts with these Terms for the covered services.
1. The Magister platform
Magister is an agentic execution platform that lets you design visual AI workflows in Studio and compile them into production-grade streaming pipelines. The platform includes built-in non-functional requirements such as security, governance, scalability, and performance optimisations described on our website and documentation.
We may update Magister features, documentation, and demo environments from time to time. We will use reasonable efforts to avoid materially reducing core functionality during a paid subscription term, except where required for security, legal compliance, or discontinuation of third-party dependencies.
2. Deployment models
Magister is offered under multiple deployment options. Your rights, responsibilities, and service levels depend on the model selected at purchase or sign-up.
Managed SaaS
Under Managed SaaS, Mach41 hosts the platform. You access Studio through a browser and build pipelines without operating underlying infrastructure. We are responsible for platform availability, patching, and operational management of the hosted environment, subject to your plan and any applicable service-level commitments in your agreement.
- You are responsible for pipeline design, connected data sources, API credentials, and lawful use of AI models and third-party services you configure.
- Platform data and operational logs are stored in infrastructure we operate or designate, as described in our Privacy Policy.
Self-Hosted
Under Self-Hosted deployment, Magister runs as Docker containers on servers you control. You receive a licence to run the software in your environment with full control over infrastructure, networking, and data egress.
- You are responsible for provisioning, securing, backing up, and maintaining your servers, containers, and network configuration.
- Your team licenses and governs the deployment for your agents and users.
- Customer content and pipeline data remain on your infrastructure. Mach41 provides software updates, documentation, and support according to your plan; we do not operate your environment unless separately agreed.
- Licence keys and usage validation may require limited connectivity to Mach41 systems.
Mach41 Hosted
Under Mach41 Hosted, we operate a dedicated Magister environment for your organisation. You receive the isolation and control benefits associated with a dedicated deployment, while Mach41 manages hosting, operations, and platform maintenance.
- Data residency, dedicated resources, support response times, and subprocessors are defined in your order form or enterprise agreement.
- You remain responsible for users, pipeline content, integrations, and compliance with laws applicable to your use of the platform.

3. Accounts and eligibility
You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account. Magister is intended for business and professional use. You must be at least 18 years old and have authority to bind your organisation where you register on its behalf.
4. Acceptable use
You agree not to:
- Use Magister or our website in violation of applicable law or third-party rights.
- Attempt to gain unauthorised access to systems, accounts, or data.
- Reverse engineer, decompile, or circumvent licence or security controls except where permitted by law.
- Introduce malware, interfere with service operation, or abuse rate limits or fair-use policies.
- Use the platform to process special-category personal data or regulated data unless your agreement and controls explicitly support it.
We may suspend or terminate access for material breach or risk to the service or other customers.
5. Customer content and data
You retain ownership of data, prompts, documents, models configuration, and outputs you submit through Magister ("Customer Content"). You grant Mach41 a limited licence to host, process, transmit, and display Customer Content solely to provide and support the service, improve reliability and security, and as otherwise permitted in your agreement.
You represent that you have all rights necessary to provide Customer Content and connect third-party systems. You are responsible for notices, consents, and compliance obligations relating to data you process through Magister.
6. Intellectual property
Mach41 and its licensors own Magister, Studio, documentation, website content, trademarks, and all related intellectual property. Except for the limited rights expressly granted, no rights are transferred to you. Feedback you provide may be used by Mach41 without obligation.
Pipeline definitions you create remain yours, subject to the platform licence above. Open-source components included in Magister are licensed under their respective terms.
7. Third-party services and AI models
Magister integrates with third-party APIs, models, databases, and cloud services you configure. Those services are governed by their own terms and pricing. Mach41 is not responsible for third-party outages, model behaviour, or data handling by external providers.
You are responsible for monitoring AI outputs, implementing human review where required, and ensuring use cases meet your internal policies and regulatory obligations.
8. Fees and trials
Paid plans, usage limits, fair-use policies, and billing terms are described on our pricing page and in your order documentation. Unless stated otherwise, fees are non-refundable. Free or community tiers may be modified or discontinued with reasonable notice.
9. Support and service levels
Support scope, onboarding, and any uptime commitments depend on your plan and deployment model. Self-hosted customers are responsible for first-line operational issues in their environment; Mach41 provides software support as specified in their agreement. Managed SaaS and Mach41 Hosted customers receive platform operations support from Mach41 according to their tier.
10. Confidentiality
Each party may receive confidential information from the other. The receiving party will use reasonable care to protect it and use it only for purposes of the relationship, except where disclosure is required by law.
11. Warranties and disclaimers
We provide Magister and the website using commercially reasonable skill and care. Except as expressly stated in a written agreement, the service and website are provided "as is". We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
AI-generated outputs may be inaccurate or incomplete. You are responsible for evaluating outputs before relying on them in production or regulated decisions.
12. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Mach41's total liability arising from these Terms or the service is limited to the fees you paid to Mach41 for Magister in the twelve months before the event giving rise to the claim, or one hundred pounds (GBP 100) for free-tier use, whichever is greater.
Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or fraud.
13. Term and termination
These Terms apply while you use the website or Magister. You may stop using the service at any time. We may suspend or terminate access for breach, non-payment, or legal requirement. Upon termination, your licence to use Magister ends and you must cease use of the software; provisions that by nature should survive (including IP, confidentiality, limitations of liability, and governing law) remain in effect.
For Self-Hosted deployments, you must uninstall Magister and destroy licence materials when your licence expires unless renewed.
14. Changes to these Terms
We may update these Terms by posting a revised version on this page. Material changes to paid customers will be notified through the service or by email where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where mandatory consumer protection laws in your country give you non-waivable rights to bring proceedings elsewhere.
